Abstract

In this article, the author studies the regulation of the rights of indigenous peoples in Argentina, focusing specially on the conflict between criminal law and customary indigenous law. In this way, he firstly explains the content of the constitutional reform of 1994 and examines several decisions of the Argentinian Supreme Court on the matter. Secondly, he analyses the relationship between the States ius punendi and the duty to respect cultural identity and diversity. Finally, he explains in which way the lack of respect for fundamental rights and identity of indigenous peoples, apart from violating domestic law, may lead to international responsibility. This is so, because according to the Constitution of Argentina, international treaties on human rights prevail over domestic statute laws.
