Abstract

In this article the author offers a definition of the State with the purpose of understanding the epistemological proposal of the transitional State, which in turn is a paradigmatic expression that makes it possible to understand the transformations experienced today by this form of organizing political power all around the world. To achieve his purpose, the author explains different conceptions on the State, he also analyses the most important elements that characterized the transition from the feudal State to the modern State, and offers his own conception of what he calls the transitional State. The author explains that the latter shall be a product of the integration processes that are being experienced today by legal systems, which in turn shall imply putting some distance in relation to the national dimension of the State.
