Abstract

Discretionary powers of federal and local authorities in relation to the imposition of excessive fines, as a consequence of real or supposed infringements to the rules on political activities financing, is a fundamental topic that deserves a deeper examination. Thus, this essay discusses the loopholes that exist in Mexican doctrine, legislation and case law in this area nowadays. The consideration of Mexican and comparative administrative law on the determination of abuse of power and imposition of fines, examined in the light of two cases (the so called "Pemexgate" and "Amigos de Fox" cases), help to clarify current practices that occur in electoral campaigns in Mexico.
