In 2000 and 2003, the election of representatives to the Legislative Assembly of the Federal District was a matter of judicial disputes centered on the distribution of proportional representation seats. As the authors of this essay explain, in both cases, the so called "governability clause" was at the center of the discussions because, under certain conditions, it would automatically grant control of the Assembly to the party with more seats elected though the principle of relative majority. In 2003, the interpretation of applicable statutes rendered three different proportional representation apportionments. Hence, it is argued that the "governability clause" should be abrogated and the maximum number of seats for each party should be reduced.
