Abstract

Mexican legal doctrine has hardly paid attention to the study of the general theory of precautionary measures. The opposite occurs in European countries were such topic has been discussed in detail. The lack of systematization of such measures in the Mexican legal system, causes confusion in relation to their nature, reach and application. This article examines, from a comparative point of view, European Communitarian Law on precautionary measures, for the sake of making a contrast with Mexican law on this subject, and thus identify how the Mexican system could be improved.
