In Mexico, the actual legaly figures taht bestow intellectual property rights -origin denominations. Patents, industrial secret, vegetable varieties- are not enough to cover the traditional knowledge, since this is not considerate a formal knowledge for lacking systematization, experimentation, validation and written registration. The article purpose is to show that the traditional knowledge has process and create products and subproducts. The field data and a review of the actual legislation in the matter of intellectual property rights, give elements to affirm that exist incongruity between the international treats and agreements ratificated by Mexico and the juridical Mexican corp.
