The aim of this work is to analyze the legality of the political parties that defend in compatible ideologies with the democracy and the human rights in the context of the Council of Europe. In this respect, the European Court of Human Rights deduces of the European Convention on Human Rights a concept of militant democracy that prevents the existence of undemocratic parties. From a constitutional point of view, first it is studied the concept of democratic society and the right of association in the European Convention on Human Rights. Later we analyze the jurisprudence of the European Court of Human Rights on the prohibition of political parties, particularly the case of the Welfare Party of Turkey.
