Abstract

The communitarian protection system of human rights has essentially pretorian nature. This, in effect, the work of one of the most significant organisms of the European Union, the Court of Justice of the European Community, that made possible the proper and really creation, in the lack of norms and in the lack of an own catalog of fundamental rights, of a protection system of treaties of a great originality. An activity, such as this, it's been possible by the Court of Justice thanks to the resource of the common constitutional traditions of the members States, and other fonts such as the Declaration of Fundamental Rights, no matter it has not juridical effect, have been an important cultural function.
