The arbitration under the auspices of the International Centre for Settlement of Investment Disputes (ICSID) has had a tremendous impact in Latin American countries. ICSID Arbitration not only requires a consent in writing, but also has specific requirements ratione personae and ratione materiae that need to be complied with. This article addresses these different matters and intends to give an overview of the amendments to the arbitration rules that entered into force in April 2006.
