Abstract

URIBE ARZATE, Enrique. The Constitutional Defense of the Fundamental Rights in the Reform of the State in Mexico. Bol. Mex. Der. Comp. [online]. 2009, vol.42, n.125, pp.1023-1046. ISSN 2448-4873.

At the core of the Reform of the State we identify the fundamental rights and its guarantee. Is not conceived a constitutional State lacking suitable, feasible and effective mechanisms for the protection, insurance and defense of the rights of the inhabitants. To guarantee the fundamental rights, it is necessary that the Reform of the State in Mexico, includes the design of a system of constitutional justice with jurisdictional specializing organs: To federal level with the creation of the Constitutional Federal Court; to local level, with the creation of Courts or Constitutional Rooms with definite competence over constitutional justice, independent from the courts that work for the ordinary justice.
