Abstract

VASCONSELOS MENDEZ, Rubén. Constitution, Criminal Accusatorial System, and Autonomy of Public Prosecutors: The Case of Oaxaca. Bol. Mex. Der. Comp. [online]. 2009, vol.42, n.126, pp.1499-1548. ISSN 2448-4873.

This paper aims to analyze the principle of autonomy of the Public Ministry in the light of recent reforms to the Constitution and taking as bench mark the case of Oaxaca. This arises, due to the implementation of a system of criminal justice in the State, the need to adapt the present conception of the nature of the State prosecutor for the new functions that he has been attributed and the need to analyze the institutional and procedural activity to determine the meaning of the principle of autonomy of the institution and its representatives, which will be implemented by various means such as the institutional location, the appointment of its holder, the career professional service, among others.
