Abstract

The paper aims at es lab lishing to what extent the Inter-American Court of Human Rights has established, through the dynamic interpretation of the American Convention, a legal regime of protection of the human rights of the indegenous people that takes into account its specificities. The first part of the paper deals with the sociological interpretation of the American Conven lion, which goes beyond the internal legalisms in the matter of the protection of the indigenous people. The second part explains how this legal interpretation was elevated as a valid response to the challenge of the heterogeneity of the Latin American societies. Finally, the last part analyzed how the Court, through this dynamic jusisprudence, provides the required foundalions of a platform for regional reconciliation.
