Abstract

URIBE ARZATE, Enrique. An Epistemological, Approach to the Human Rights from an Existential-Pragmatic Dimension. Bol. Mex. Der. Comp. [online]. 2011, vol.44, n.132, pp.1233-1257. ISSN 2448-4873.

The two classical references on human rights are fragile and have insurmountable limitations. The typical explanations of the emergence of human rights, refer to the "generations" of those mentionated rights whose only reason is the temporal-historical dimension. This dynamic suggests that rights' existence analysis, depends on historical moments, furthermore, that its substantive dimension is something different to his warranty. Therefore, it is high time, we turned this epistemological model, as far from the common tendency to disrupt the human rights' concept from its warranty, it is compulsory, that both views were seen as inseparable parts of what we have called the existential-pragmatic dimension of human rights.
