Abstract

NIEDRIST, Gerhard  and  FIGUEROA BELLO, Aída. The People vs. the United Nations: How Can Individuals Claim their Rights at the UN?. Bol. Mex. Der. Comp. [online]. 2015, vol.48, n.143, pp.731-762. ISSN 2448-4873.

This article aims to analyze how individuals can demand accountability and justice from the United Nations. In this sense, we can see that the individuals lack legal mechanisms at both international and national courts to enforce their rights against the United Nations. We will examine cases that have been filed against the United Nations before national courts and analyze if in this way their responsibility can be determined effectively. Finally, we will discuss the ways through which the protection of individuals against the United Nations can be strengthened, either by strengthening existing legal instruments or by analyzing the possibility that the UN can be member of human rights treaties.
