Abstract

Fundamental rights are applicable in the present and so on, however, there are legal and factual situations suggest the need for its application to events occurring before its validity when it comes to maximize, and preserve their core essential and accomplishment. With these assumptions, we formulate an indicator that prevents static conceptualization of fundamental rights and even the Constitution, in order to give a dynamic sense and allow them transversal application in situations arising before its effective.
