Abstract

This article justifies shared custody, even with opposition from one of the parents, as a preferred preferential legal scheme, but above all as a specific scheme within a system of indistinct custody. Joint custody is based on the fundamental rights of children and adolescents (principles of best best interest and co-responsibility), but especially in empirical studies.
