Abstract
BARCIA LEHMANN, Rodrigo. The two Forms of Shared Custody in Case the Parents do not Agree [Part one]. Bol. Mex. Der. Comp. [online]. 2018, vol.51, n.153, pp.457-480. Epub Apr 20, 2020. ISSN 2448-4873. https://doi.org/10.22201/iij.24484873e.2018.153.13647.
This article justifies shared custody, even with opposition from one of the parents, as a preferred preferential legal scheme, but above all as a specific scheme within a system of indistinct custody. Joint custody is based on the fundamental rights of children and adolescents (principles of best best interest and co-responsibility), but especially in empirical studies.
Keywords : custody and shared personal care; coresponsibility of parents; equality of parents; best interests of the child.
