Abstract

GONZALEZ MORALES, Felipe. Supervision of the Compliance of Cases by the Inter-American System and its Contrast with the European System. Bol. Mex. Der. Comp. [online]. 2018, vol.51, n.153, pp.551-586.  Epub Apr 20, 2020. ISSN 2448-4873.  https://doi.org/10.22201/iij.24484873e.2018.153.13650.

The inter-American human rights system has significant .shortcomings in the degree of compliance with decisions on cases of their organs by States. To date, such supervision has been carried out by the Commission and the Inter-American Court, without significant participation of the political organs of the Organization of American States. In the European human rights system, meanwhile, for decades supervision was carried out exclusively by a political mechanism (the Committee of Ministers) and only recently has the European Court of Human Rights begun to play a role in this regard. After contrasting the inter-American experience with the European experience, the work proposes establishing a system of dual supervision (judicial and political) in the inter-American framework, in order to strengthen the compliance of cases by States.

Keywords : Inter-American human rights system; european human rights system; supervision of resolutions; supervision political mechanisms; supervision judicial mechanisms.
