Abstract

WITKER, Jorge. Mining Activity, the New NAFTA and Human Rights. Bol. Mex. Der. Comp. [online]. 2018, vol.51, n.153, pp.739-760.  Epub Apr 20, 2020. ISSN 2448-4873.  https://doi.org/10.22201/iij.24484873e.2018.153.13655.

In the times when the renegotiation of NAFTA for the three countries is happening, it is appropriate to point out that human rights, from Article 1 of the Constitutional Reform of 2011, oblige Mexican negotiators to respond differently to the investments than via concessions, Canada, participates mainly in the mining activity, with negative socio-environmental effects for communities and towns, where large mining companies of Canadian and American origin operate. The reflections of this article are destined to this theme.

Keywords : mining; investment; renegotiation; environment; NAFTA; concession; displaced agrarian centers.
