Abstract

Recently, the First Chamber of the Supreme Court of Justice of the Nation issued a resolution in which it declared the admissibility of punitive damages in Mexican law, in matters of moral damage. However, applying a detailed analysis of the sentence, its arguments and grounds, leads us to the conclusion that this figure has very little in common with the "punitive damages" applied in the common law legal systems, and refers only to how to quantify the compensation awarded to the victim.
