Abstract

Based on several communities of the Ecuadorian Sierra, this paper analyses the changes in Ecuador's indigenous justice after the 1998 constitutional reform. We consider the 1998 Constitution as a breaking point in the indigenous practice of justice in Ecuador: while their recognition by the constitution provides a new legal basis for the ancestral forms of practicing law, it also has a dynamic effect on them. This is what we call "post-constitutional dynamics" in indigenous communities.
