The purpose of the text is to discuss the construction of the right to education in Mexico in the context of the country’s transitions and the formation of the constitutional state. The text starts from an understanding of the culture and distinguishes four transitions in the country. It analyzes Mexico’s constitutional history, and within that significant landmarks in secondary legislation. We conclude that Mexico has developed on the foundation of a project for the democratic rule of law and in the nation’s transitions education has been a key component of nation-building; also, we maintain that educational legislation, while presenting variants at different times of restructuring of the national project, at present incorporates fundamental values of Mexico’s historical heritage and offers a renewed perspective on the responsibility of the state as guarantor of the right to education.
