Abstract

The paper explores the constitutional legislation and the indigenous rights in Latin America. At the beginning, the paper make a historical reflection of the concept of self-determination and the recognition of the ethnic and cultural plurality of the States, as well like as the notion of legal pluralism and democracy of citizenship. It concludes that the reformulation of the Latin American States necessarily will have to reach the legal systems, making them more sensible to the ethnic specificities and the indigenous rights.
