Abstract

The existence of the patient’s vulnerability due to ethical and/or legal problems is known, which invariably translates into malpractice; however, the term is used as equivalent to negligence, and the author, who argues in this regard, disagrees. Subsequently, to develop the topic, it is hypothesized that the ethical-legal distinction of medical malpractice will contribute to its better understanding and, consequently, there will be a greater chance of avoiding it.
