Abstract

This paper analyses the limits underlying any discussion about the conflict between the Constitutional Court and Parliament. To this end, the author proposes that an adequate political philosophy must be able to combine certain ideals (thus giving to it a normative character) with an adjustment to reality (in order to be feasible). To be able to adapt to reality, any theory of democracy must take into account, first of all. the circumstances of jurisdiction (that define what is required of a Constitutional Court) and the circumstances of politics (that define what is required of a Parliament).
