The purpose of this project is to offer an innovative conception of the quality of education that considers other viewpoints. The conception is based on the product of the relationship between two fundamental factors in individual formation: learning and equity. The article’s starting point is that the reformation of the third article of the Constitution, in 2013, linked the quality of education to learning, with a focus on attaining equity and social equality. Thus the perspective of education as a right was reinforced. An analysis is made of the concepts of learning and equity, with an emphasis on their legal elements; in other words, on their belonging to the educational axiology established in the Constitution. Equity is shown to have a double dynamic: one formed by an individual’s educational experiences as an expression of a right; and another represented by all the government and social work that creates conditions for equity to exist in society, promoted by public policies. Thus school achievements and learning have a multiplying factor.
