The law must be as dynamic as society itself, the regulatory system must be reviewed on a permanent basis and the legislator must make the necessary adjustments so that the rights are dynamic in terms of effectiveness. With respect to the protection of the heritage of older adults, it is a priority to review not only the harmonious regulations that the judge has to apply, since in the daily judicial work the most varied actions are perceived, exercised by relatives to strip away older adults of their possessions, without them receiving direct benefits. This work is conducted, under the self-experience of judges of the State of Mexico, a revision to the tendency that is lived regarding the protection of the patrimony of older adults. It is done in this entity since its geopolitical and demographic situation allows to consider the sum and synthesis of the problematic that is lived in the Mexican Republic.
