Abstract

JACOBO-MARIN, Daniel. Energy regime, water uses and legal antinomies: The case of fracking in Mexico. Econ. soc. territ [online]. 2022, vol.22, n.70, pp.921-949.  Epub Nov 14, 2022. ISSN 2448-6183.  https://doi.org/10.22136/est20221822.

The objective of this article is to analyze the regulation of fracking in the Mexican legal order. Regulatory antinomies generated with the explicit approval of the aforementioned technique are documented, particularly those relating to the order of priority of water uses and the injection of chemical substances into the subsoil. The constitutional paradigm for the use of hydrocarbons is described in terms of the 2013 energy reform and the derived regime. It is concluded that the regulation of the extraction of unconventional hydrocarbons generated legal imbalances that remain unresolved.

Keywords : fracking; energy reform; water uses; hydrocarbons; precautionary principle.
