Abstract

This paper studies the legal problems derived from application of modern techniques for assist human reproduction, which has an impact not only in family law topics, as filiation, obligations, successions but also in different human rights like life, physical integrity, privacy, identity and others. After reviewing the legal systems of Spain, France, Switzer land, and Costa Rica and explaining the Catholic Church position, the author studies the coincidences and divergences of those regulations. Then reviewing the Nicaraguan family law, which has no regulation about the assist reproduction, the author considers different solutions to different legal problems, specifically about filiation, successions and contracts. These hypothetical situations could take place in the aplication of assist reproduction techniques and the results could be useful for other countries with no regulation about it.
