Abstract

This paper refers to situations determining the adoption of emergency powers so we submit succinctly the fundamental concepts that re late to the rule of law as legal order, human rights and its guarantees, then, we enter fully analyzing the subject on the Oriental Republic of Uruguay. The emergency powers are instruments of constitutional law in order to protect the rule of law when exceptional circumstances are attacking it. State of siege and martial law are classic examples. Their precise and limited constitutional regulation is a fundamental procedural guarantee. The suspension of certain human rights requires such a regulation in detail.
