Throughout the analysis of the arguments developed by the Spanish Constitutional Tribunal and the French Constitutional Council, this article is questioning about the risks related to the consecration in legal instruments —normative acts as well as judgments— of historical research, a matter by definition unlimited and constantly evolving.
