Abstract

QUINTANA OSUNA, Karla I.. The Mariana Lima-Buendía case: an in-depth scan of violence and discrimination against women. Cuest. Const. [online]. 2018, n.38, pp.143-168. ISSN 1405-9193.  https://doi.org/10.22201/iij.24484881e.2018.38.11878.

On March 25, 2015, the Mexican Supreme Court of Justice issued a decisión related to the investigation of Mariana Lima-Buendía s violent death. This judgment sets forth the first decisión related to the femicide. The decision is also relevant as it recognizes the right of women to a life free of violence and discrimination, underlining the authorities' obligation to investigate and to prosecute with a genderperspective and it also establishes an effort to recognize a comprehensive reparation based on human rights violations. The decision also opens several debates; as the scope of the constitutionalparameter control, such as if it is appropriate for a constitutional tribunal to analyze, in detail, aprosecutor's investigation, or the scope of reparations through a writ of protection (juicio de amparo). The decision shows that a judgment may constitute a form of reparation, and a guarantee for the right to truth.

Keywords : Femicide; Violent Death of a Woman; Violence and Discrimination Against Women; Gender Perspective; Violation of Human Rights; Reparations; Right to Truth.
