Abstract

The right to personal identity is a crucial human right. In order to correct personal documents that fits with personal identity, transgender people have struggled. Lack of regulation and individual cases by judiciary, have shown that there are no sufficient means to protect rights of a community that has been discriminated. This research proposes that Mexican Supreme Court, acting as a constitutional court, issues a structural injunction in order to make visible the need to regulate this issue. Constitutional clauses that are already set on Mexican constitution are sufficient to issue the proposed resolution.
