Abstract

The Mexican Supreme Court recently solved several actions of unconstitutionality regarding several amendments to State Law regulations on self-defense in Mexico. The amendments explicitly expressed the type of damages that an individual may cause under self-defense, including the death of the aggressor. The Supreme Court upheld the constitutionality of such dispositions. This article analyzes the framework of self-defense in the Mexican Constitution. The authors provide a critical lecture of the Supreme Court resolution and propose an alternative position that questions the validity of such regulations.
