Abstract

ARBOLEDA RAMIREZ, Paulo Bernardo  and  JIMENEZ RAMIREZ, Milton César. Constitutional substitution in Colombia: Reform limits to the Derivative Constituent Power (Legislative Function). Cuest. Const. [online]. 2021, n.45, pp.437-449.  Epub May 09, 2022. ISSN 1405-9193.  https://doi.org/10.22201/iij.24484881e.2021.45.16670.

In the present work, the legal phenomenon of constitution substitution is studied, which occurs when a defining element of the essence of the 1991 Constitution, instead of being modified, is replaced by an opposite or entirely different one. In this vein, the substitution of the constitution is a figure created by the Constitutional Court of Colombia through ruling C-551 of 2003. Thus, the objective of the work is aimed at identifying the origin and development of the theory of substitution of the constitution in constitutional jurisprudence.

Keywords : political constitution of 1991; democracy; principles; constitutional substitution.
