On November 4th, 1826, the State of Mexico’s Constituent Congress enacted a decree that annulled the first legislative elections of because of alleged irregularities and fraudulent practices throughout the electoral process. On December 14th, the Government Commission of the Federal Senate issued a verdict that nullified the decree. In this article, I analyze the debate that arose from these dispositions, regarding the limits and attributions federal sovereignty had over the local one. This affair exhibits the problems arising during the constitution of Mexico as a federate republic in the nineteenth century, in which two authorities did not always consent: the free and sovereign states, and the federation.
