Abstract

The article analyzes the legislation and government actions carried out in Mexico during the period of 2007-June 2014 in order to face the phenomenon of bullying (Olweus, 1978; 2003), highlighting the insufficiencies in its legal framework to avoid bullying given that it mainly focuses on punishment rather than prevention. The main argument states that it is possible to effectively prevent bullying within a target population (Schneider and Ingram, 1993): the intellectually gifted children and adolescents (Peterson and Ray, 2006; Robinson, 2002), based on a strategy focused on reforming the General Law of Education with the purpose of allowing the implementation of the "home schooling" model at the basic education level, as an alternative mechanism to prevent bullying of intellectually gifted children and adolescents.
