Abstract

This article refers to a sentence of the Court of Salta, Argentina, about a Wichí man, charged with raping the daughter of his concubine. I talk about a legal colonialism in the treatment of the case by the Argentine State, and of discursive colonialism in the assessment of the case by several instances of power. I base this in what I call a "theory of voices" from the conceptualization of Aníbal Quijano of "coloniality of power", that includes a treatment of the politics of subjectivity in progress. I inquire about the limits of some voices from academic feminism to think about the context of "colonialism" and what I call "Salvationist Rhetoric": the continued attempts by some feminist voices to silence the women of color/non-white or, to speak for them.
