Abstract

The purpose of the paper is to explore the theme of the principles of the new juridical branch of Health Law, showing the philosophical and epistemological aspects. The theoretical framework is complex thought and -renewed- trialism, and the methodology is qualitative, with a predominance of philosophical, argumentative and documentary analysis. The main result is the historical contextualization, clarification of abstraction and systematization in the branch, achieved through the exposition of principles, with philosophical support, which constitutes an epistemological achievement, even more essential if the branch is in a consolidation period. This paper is closely related to another one where empirical support of the principles is provided, based on national laws and decisions of the highest Argentine Court.
