Abstract

RICO CARRILLO, Mariliana. The challenges of criminal law against computer crimes and other fraudulent behavior through electronic means of payment. Rev. IUS [online]. 2013, vol.7, n.31, pp.207-222. ISSN 1870-2147.

The developments of computer science, telecommunications and Internet have facilitated the appearance of new fraudulent behaviors in the use of electronic means of payment. The difficulty of framing the new criminal offenses in traditional crimes has led to the review of the legislation in order to avoid impunity for such criminal behaviors, just as it happened in the reform of the Spanish Penal Code in 2010. This research aims at the analysis of cyber crimes and other fraudulent conducts related to the use of electronic payments and different solutions offered by the Spanish penal legislation to prevent and punish this type of behaviour.
