Civil medical liability has undergone a paradigm shift in the Federal Judicial Authority which will be evaluated in the present article. The present study aims to analyse civil medical liability and punitive damages in order to determine whether the jurisprudential criteria coincide with the Romano-Germanic system applied here in Mexico and whether punitive damages can be exempt from application in public administration bodies. The methodology used analytical doctrine, comparative law and case studies.
