Abstract

The present article addresses the two liability regimes concerning the transport of goods by sea, known respectively as the Hague-Wisby Rules and the Hamburg Rules. Likewise, the author briefly analyzes the draft convention on the subject, which is being developed by Uncitral. Although it may be concluded, that the instrument offers greater effectiveness and fairness to the system, the potential abuses to the regimen through the illegitimate handling of the volume contracts shall be a warning to the legal community.
