Abstract

Contemporary international public law has as one of its characteristics the consolidation of legal individual subjectivity. Precisely, this paper seeks to analyze the active dimension of such subjectivity, it means, the effective right to individual claims before international tribunals. In order to reach the above-mentioned purpose, firstly, a reference to the evolution of individual subjectivity will be done as well as theories about this topic. Then, we will focus on the individual's participation in the international systems of human rights protection regarding the universal system and regional approaches, too. Finally the victim's situation before the International Criminal Court will be studied.
