Abstract

GARCIA SAN JOSE, Daniel. Approach to the european common legal frame regarding human cloning research. Anu. Mex. Der. Inter [online]. 2010, vol.10, pp.567-588. ISSN 1870-4654.

In this contribution, the author defends, the existence in Europe of inferring principles concerning the research on human cloning and with stem cells from human embryos. Thanks to the Council of Europe, such principles dealing with the process and object of this research, but also concerning the juridical protection of the patent of the result of that research, can be seen as the minimum common to European countries on this topic. These inferring principles in the European context could be worth to be followed at universal level, notably in United Nations, in order to get inspiration for leaving the current lack of consensus among States preventing an international regulation on this issue.
