Abstract

ALFIE, Ana Clara. Conflicts and right to strike: reflections from the case of Argentina. Rev. latinoam. derecho soc [online]. 2012, n.15, pp.3-33. ISSN 2448-7899.

This paper approaches different theoretical perspectives regarding collective labor conflicts highlighting the social dimension of these disputes. For this purpose, the conflict theory and the consensus theory will be contrasted. After a brief historiographic review about conflicts in preindustrial societies, the conflicts in modern societies will be analyzed. The analysis will be focuses on the conflicts expressions, and the supposed costs that strikes cause for actors involved in them. The approach will be predominantly legal, in that way the in force international law will be analyzed, going through regulations in Latin America, and specifying details in the Argentinean labor legislation. Finally, the channeling modes of labor dispute will be studied, especially those characterized by conciliation or arbitration instances.
