Abstract

Undoubtedly the constitutional recognition of the inalienable, indefeasible and nonnegotiable access to public social security service right exists through all America, in fact, in all countries of the world, because it's an unavoidable obligation contemplated in the by Article 22 , and then by the content outlined at the Article 25 of the Universal Declaration of Human Rights. However, the legal binding force of the declaration has not been properly understood by the jurists in the complex process of constitutionalization of social security, so it's legal analysis is relevant because of its undoubted moral, ethical and legal force, crucial in a globalized world in all areas where the issue of human rights in the twenty-first century, has become a key and priority.
