The study of the current labor situation in Mexico, derived from a diluted state of law can help to achieve a better social reality in general terms and in particular to achieve the goals of decent work established both in the constitution and international treaties. The above, through reflection and theoretical analysis and a qualitative methodology, complemented with historical bases, and a documentary and contextualized research, to understand, explain and propose a possible solution to the country’s outrageous labor situation. Understanding that millions of people in Mexico do not have a decent job that provides them access to social security, pay a salary, have continuous training and safety and hygiene conditions to prevent risks to their integrity. What in fact, these millions of jobs are developed in an unconstitutional way. It is for that reason, that it considers essential the legislative transformation as well as institutional to materialize the ideals embodied in our labor law.
