Abstract

The social security system of Ecuador includes a specific protection for people who perform unpaid domestic work. This protection was included by the Law for Labor Justice and recognition of unpaid domestic work of April 20, 2015, which reformed the Social Security Law. The law responds to a specific mandate established in the Ecuadorian Constitution of 2008.
The insertion of this unpaid work within the scope of protection of the social security system pursues, beyond the objective of granting basic protection, the gradual empowerment of women reducing economic dependence. Despite the relevance of these objectives, the system has received criticism, focussed on the assertion that the recognition of benefits will stimulate the sexual division of work and the permanence of women at home, since, at the moment, there are no relevant measures for co-responsibility in care in the Ecuadorian system between men and women.
Based on the theoretical framework of the sexual division of labor and the need to modify the labor standards regarding the question of parental leaves, the article adresses the analysis of the operation and benefits recognized by Ecuadorian legislation for unpaid work in the home
