The general objective of this paper is to analyze, through legal argumentation, the human right to housing in Mexico based on Article 11 of the International Covenant on Economic, Social and Cultural Rights, Article 123 of the Constitution and Article 3 of Law of the Institute of the National Housing Fund for Workers (Infonavit) by establishing that must be given “cheap” credit to workers, is observed by Ferrajoli that at a factual level the credit granted to workers is not less than that granted by banking institutions, it is equal and in some cases superior, the Toulmin model and MacCormick argument categories are used as a relation between the premises and the conclusion.
