Abstract

The article aims to propose that the Mexican State be recognized as a social State of law. To do so, it is necessary to approach the concepts of the social State of Law and the Welfare State. Establishing the defining elements of the states of this type allows us to contrast these with the characteristics of the Mexican State and observe that we do not have the legal framework or economic policies that would declare that there are legal bases of a social or Welfare State. Finally, in a third section we made a proposal to “amend the path” and begin the construction of a genuine Welfare State with the clear objective of achieving social justice.
