Abstract

MEDINA ALVAREZ, Ulises Nelson. Current problems of social constitutionalism: a contemporary crisis with Latin American solutions. Rev. latinoam. derecho soc [online]. 2023, n.37, pp.145-156.  Epub Jan 12, 2024. ISSN 2448-7899.  https://doi.org/10.22201/iij.24487899e.2023.37.18542.

The social constitutionalism has experienced a crisis that has been dragging on since the 1970s, due to socioeconomic and political-ideological factors. Through an explanatory and correlational analysis of its historical, legal, political and economic aspects, we will address the depth of this crisis and its current scope, as well as the solutions proposed through the so-called new Latin American constitutionalism, which with its own unique features and individuals, proposes a renewed and reinforced Social Constitutionalism in the current world scenario.

Keywords : social constitutionalism; new latin american constitutionalism; social rights; Latin America; neoliberalism.
